Judge Rules Kim's Property Was Seized Under Court Order That Should Never Have Been Granted

Internet tycoon Kim Dotcom's cash, cars and property were seized using a court order which should never have been granted.
A judgment from Justice Judith Potter on Friday declared the restraining order "null and void" and having "no legal effect".
The blunder might now lead to the beleaguered internet mogul getting back everything that was stripped away in the surprise dawn raid on his mansion eight weeks ago.

Our leaders ignore or enforce the laws as they see fit. Of course, when it affects them or their "important constituents", they interpret them to favor those interests.

Kim DotCom warrant 'invalid,' New Zealand judge rules

The U.S. piracy case against MegaUpload founder Kim DotCom appears to have run aground, with a New Zealand court ruling that the warrants issued for the property seizures in January were invalid.
New Zealand High Court Judge Helen Winkelmann ruled today that the warrants did not adequately describe the offenses alleged, according to a report in the New Zealand Herald. "Indeed they fell well short of that," she said. "They were general warrants, and as such, are invalid.''

MegaUpload's lawyers are expected to appear in a Virginia federal court on Friday to argue that the charges should be tossed out.
DotCom recently received the support of Apple co-founder Steve Wozniak and famed former hacker Kevin Mitnick, who told DotCom, "I hope you win."

Megaupload’s Kim Dotcom: Joe Biden is in bed with the MPAA

The strange and amusing saga of Megaupload founder Kim Dotcom took another interesting twist on Tuesday when Dotcom toldTorrentFreak that none other than Vice President Joe Biden himself ordered the federal government to shut down his file-sharing site. Though no firm evidence of Vice President Biden’s involvement was presented, Dotcom does have a semi-plausible explanation for the veep’s interest in his site: Biden is good friends with former Senator Chris Dodd, who is now living out his glory years shilling for Hollywood’s anti-piracy efforts.

“After we received information from an insider we scanned the White House visitor logs for all meetings of Chris Dodd and studio bosses with Joe Biden and Obama,” Dotcom said. ”It is interesting that a man by the name of Mike Ellis of MPA Asia, an extradition expert and former superintendent of the Hong Kong police, was also at a meeting with Dodd, all studio bosses and Joe Biden. The same Mike Ellis met with the Minister of Justice Simon Power in New Zealand.”

As Gizmodo notes, Dotcom seems to be engaging in some speculation here since he only has circumstantial evidence that Biden was at all in the loop on the government’s decision to go after Megaupload, and he certainly doesn’t have any definitive evidence that Biden personally ordered the raid. Gizmodo does say, however, that Dotcom claims to have more details to back up his accusation and he “plans to release them when the time is appropriate,” so there may be more on this story to come.
